1. Acceptance of these Terms
These Terms of Service (the “Terms”) form a binding agreement between you and CardStock Inc. TODO: replace with exact registered legal name once incorporated (“CardStock,” “we,” “us,” or “our”). By accessing or using the website located at cardstock.cards and any related services (collectively, the “Service”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. What CardStock Is
CardStock is an independent catalog and price-comparison tool for collectible sports trading cards. We aggregate publicly available product information, pricing, and listing data from third-party retailers and reference databases, and we surface curated buy-side links to third-party marketplaces (including eBay) through our affiliate relationships.
We are not a retailer. CardStock does not sell, ship, grade, authenticate, or otherwise handle physical cards. All purchases are transacted directly between you and the third-party seller or marketplace, subject to that party’s own terms, return policies, and dispute-resolution processes.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. See the Privacy Policy for details.
4. Accounts and Sign-In
Where the Service requires authentication, sign-in is provided through Google OAuth. By signing in you authorize Google to share a limited set of profile information (your email address, display name, profile picture, and Google account identifier) with CardStock. We use this information solely to authenticate you, maintain your session, and authorize access to non-public features. We do not request, store, or use your Google password, contacts, calendar, drive, or any other sensitive Google data.
You are responsible for keeping your Google credentials secure and for any activity that occurs through your account. You agree to notify us promptly at privacy@cardstock.cards if you suspect unauthorized access.
5. Affiliate Disclosure
CardStock participates in affiliate and partner-marketing programs operated by third-party marketplaces, including but not limited to:
- eBay Partner Network. Certain outbound links to eBay listings carry affiliate tracking parameters. If you click one of these links and complete a qualifying purchase, eBay may pay us a referral commission. We are not employed by or formally affiliated with eBay beyond this commercial relationship.
- Amazon Services LLC Associates Program. As an Amazon Associate, CardStock earns from qualifying purchases. Where present, outbound links to Amazon listings carry affiliate tracking and may generate a referral commission at no additional cost to you.
Affiliate compensation does not change the price you pay, does not influence the ranking of products in our catalog beyond the criteria documented on our site, and does not create a sponsorship, endorsement, or warranty of any third-party seller or product. In accordance with the U.S. Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255) and applicable Canadian Competition Bureau guidance, we disclose these material connections here and on each surface that features affiliate-linked content.
6. Pricing, Availability, and Catalog Accuracy
Prices, stock status, product attributes, release dates, and descriptions shown on CardStock are sourced from third parties, refreshed on a schedule, and may be out of date or inaccurate at the moment you view them. The authoritative source is always the seller’s own listing at the time of checkout. We provide the catalog “as is” for informational purposes and disclaim any obligation to honor a price or availability shown on the Service.
7. Acceptable Use
You agree not to:
- Scrape, crawl, or systematically extract content from the Service except as expressly permitted by a written agreement with us or by a robots-exchange convention we publish;
- Interfere with, disrupt, or place an undue load on our infrastructure, including by exceeding any rate limits we communicate;
- Use the Service to violate applicable law, infringe intellectual-property rights, transmit malware, or carry out fraud;
- Reverse-engineer, decompile, or attempt to derive the source code of any non-open component of the Service;
- Remove or obscure any affiliate, attribution, copyright, or trademark notices.
8. Intellectual Property
The Service’s software, original copy, layout, branding, and curated editorial content are owned by CardStock or licensed to us, and are protected by Canadian and international copyright, trademark, and trade-secret laws. Trading-card product names, set names, manufacturer logos, league marks, and player names referenced on the Service belong to their respective owners; their inclusion is nominative fair use for cataloging and comparison purposes and does not imply affiliation or endorsement.
9. Third-Party Sites and Services
The Service contains links to and embeds data from third-party websites and APIs (including, without limitation, eBay, retailer storefronts, TCDB, PSA, Beckett, Google, and search providers). We do not control these third parties, are not responsible for their content or practices, and your use of them is governed solely by their own terms and privacy policies.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CATALOG DATA IS ACCURATE OR CURRENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER CARDSTOCK NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the smallest amount permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless CardStock and its affiliates from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any law or the rights of a third party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for breach of these Terms. You may stop using the Service and request deletion of your account at any time by emailing privacy@cardstock.cards. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to its conflict-of-laws rules. You and CardStock agree to submit to the exclusive jurisdiction of the courts located in TODO: confirm corporate seat city, e.g. Toronto, Ontario for the resolution of any dispute arising out of or related to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by a new “Effective date” at the top of this page and, where practicable, by notice on the Service. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
